Terms of Service

Effective August 26, 2026

1. Agreement

These Terms of Service ("Terms") govern your use of the Popcorn mobile app, website, and related services (the "Service"). By creating an account, renting a film, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Accounts

You are responsible for your account and for keeping your sign-in credentials secure. You must provide accurate information and be legally able to enter into this agreement. We may suspend or terminate accounts that violate these Terms, abuse the Service, or engage in fraud.

Ratings, reviews, and posts you publish on Popcorn are public. They may appear on public Popcorn pages that anyone can view without an account, including pages indexed by search engines, alongside your username. Do not include personal information you would not want made public. You can delete your reviews and posts at any time, and deleted content is removed from public pages when they next refresh.

3. Film rentals

Popcorn lets you rent films uploaded by verified creators. The rental price is shown at checkout before you pay. A rental gives you a personal, non-exclusive, non-transferable license to stream the film inside the Service — nothing more.

Rental windows: you have 30 days from purchase to start watching. Once you press play for the first time, you have 48 hours to finish. When either window ends, the rental expires automatically.

Rentals are for personal, non-commercial viewing. You may not download, record, capture, re-stream, publicly screen, or share access to a rented film, and you may not circumvent any content-protection measures. Doing so violates these Terms and may violate the law.

4. Payments

Payments are processed by our payment partners (RevenueCat and Stripe). Popcorn does not store your full card details. Prices may change, but a change never affects a rental you have already purchased.

5. Refunds

All rental sales are final. Because a rental grants immediate access to stream a film, we do not offer refunds for change of mind, accidental purchase, or an unwatched rental that has expired.

If a technical problem on our side prevents you from watching a film you rented, contact us at popcornapp123@gmail.com and we will make it right. If a payment is refunded or reversed for any reason (including a card dispute), the associated rental access ends immediately.

6. Creator content and revenue share

Verified creators may upload films they own or control all necessary rights to. By uploading, a creator represents that the film does not infringe anyone’s rights and grants Popcorn a non-exclusive, worldwide license limited to operating the Service: hosting, transcoding, creating thumbnails and previews, and streaming the film to viewers with active rentals, plus displaying the film’s title and artwork in the catalog and in marketing for the Service. Creators keep ownership of their films.

Creators may unlist a film at any time from creator settings. Unlisting stops new rentals immediately; viewers with an active paid rental can finish their rental window. Removal does not end a creator’s obligations for rentals already sold (including refund reversals), and Popcorn may retain archival copies as needed for legal compliance and dispute resolution.

Creators are responsible for all rights clearances in their films — including music synchronization and master-use licenses, footage, artwork, trademarks, and releases from recognizable people — and will indemnify and hold harmless Popcorn from claims, damages, and expenses (including reasonable attorneys’ fees) arising from their uploaded content or their breach of these Terms.

Creators earn 75% of net revenue from each rental of their film — the purchase price minus payment-processing fees. Popcorn retains the remaining 25%. If a rental is refunded or charged back, the associated creator earnings are reversed.

Creator earnings are paid monthly, via Stripe, to creators who have completed payout onboarding, once their balance reaches the payout minimum shown in the app. Balances below the minimum, and balances of creators who have not completed payout onboarding, roll forward and remain payable; balances unclaimed for an extended period may be handled as required by applicable unclaimed-property law. Creators are responsible for their own taxes.

7. Creator upload subscription

Uploading films requires an active creator upload subscription (price shown at checkout). The subscription gives a verified creator unlimited film uploads and keeps their approved films available to rent while it remains active.

If the subscription ends — by cancellation at the end of a paid period, non-payment, or refund — the creator’s films are removed from rental availability until it is renewed. Viewers who already paid for an active rental keep access for the remainder of their rental window. Cancelling stops future renewals but keeps the subscription’s benefits until the end of the period already paid for; a refunded or charged-back subscription payment ends upload privileges and film availability immediately. Subscription fees are otherwise non-refundable to the extent permitted by law, and rental revenue already earned is unaffected by a later subscription lapse.

8. Content standards

All uploads must be films the creator has the rights to distribute, and must not include: content that infringes any third party’s copyright, trademark, or other rights; sexually explicit or pornographic content, or any sexual content involving minors (which we report to authorities); content that is illegal, defamatory, or invades privacy or publicity rights; content promoting violence, terrorism, or hatred against protected groups; or malware, hidden data, or content that misrepresents its nature at review time.

Creators must be at least 18 years old. Films with mature themes must be flagged accurately during submission so viewers see appropriate guidance. We may reject or remove content that violates these standards, and repeated or serious violations end creator privileges.

9. Copyright and takedowns

We may review, reject, or remove any uploaded film — including films already published — at our discretion, particularly for suspected rights infringement, illegal content, or violation of our content standards. Copyright complaints are handled under our Copyright & DMCA Policy (studio.popcornapp.movie/copyright), which explains how to send a takedown notice, how creators can respond with a counter-notice, and our repeat-infringer policy: accounts that repeatedly infringe copyright are terminated.

A takedown for infringement ends streaming immediately for all viewers, including active rentals, and rentals of content removed for infringement may be refunded, with corresponding reversal of creator earnings.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available." To the fullest extent permitted by law, Popcorn disclaims all warranties, express or implied, and is not liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will post the updated Terms here and update the effective date. Continuing to use the Service after changes take effect means you accept the updated Terms.
